1. Acceptance of Terms

By accessing or using FlagAlert ("Service"), operated by Flag Alert LLC ("we," "us," or "our") at flag-alert.app, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

FlagAlert is a subscription-based notification service that sends SMS and email alerts when the United States flag should be flown at half-staff, based on official federal presidential proclamations and state governor orders. Our Service is intended to help individuals, businesses, and organizations comply with US flag protocol requirements.

FlagAlert is an informational service. While we make every effort to deliver timely and accurate notifications, we do not guarantee that all flag orders will be captured or that notifications will be delivered without delay.

3. Subscription and Billing

FlagAlert offers the following subscription plans:

• Free: no charge and no payment method required — email alerts for all federal presidential proclamations. You may view any state's current flag status at no charge; alerts for a state's own orders are part of a paid plan.
• Personal: $1.99 per month or $19.99 per year — covers all federal presidential proclamations and one state
• Business: sold by how many states you cover, with two recipients per state: $9.99 per month or $99.99 per year for one state; $24.99 per month or $249.99 per year for up to five; $59.99 per month or $599.99 per year for six to fifteen
• Enterprise: $149.99 per month or $1,499.99 per year — covers federal orders and all states and territories, with two recipients per state
• Schools & Government: billed annually by site count — $499 for up to 10 sites, $1,499 for 11–50, $2,499 for 51–150, and by quote above that. One-year terms, invoiced and payable within 30 days; no card is required. Sales tax is added where it applies unless a valid exemption certificate is on file.
• Second state (Personal): $1.00 per month or $10.00 per year for one additional state, on the same billing interval as your plan. Added mid-period, it is charged pro rata for the remainder of that period. Removing it stops the charge at your next renewal; it is not refunded.
• Contact Add-on (Business or Personal): $1.00 per month or $10.00 per year per additional recipient beyond those included

The free tier is provided at our discretion. We reserve the right to change, limit or discontinue it at any time, with or without notice. Discontinuing or changing the free tier does not affect any paid subscription then in effect.

No payment method is required to create an account. Creating an account gives you federal alerts by email at no cost, and we do not ask for card details to do it. A payment method is requested only if and when you choose to upgrade to a paid plan. Text-message (SMS) alerts are part of a paid plan.

A paid subscription may include a free trial. When a trial applies, you will not be charged until the trial period ends, and you may cancel at any time before then to avoid charges. Depending on the offer in effect when you upgrade, a payment method may or may not be required to start that trial.

Subscriptions automatically renew at the end of each billing period (monthly or annual, as selected at signup). You may cancel your subscription at any time through your account page.

4. Cancellation and Refund Policy

You may cancel your subscription at any time through your account page at flag-alert.app/account.

Cancellation takes effect at the end of your current billing period. You will retain full access to the Service through the end of the period for which you have already paid. No refunds are issued for unused portions of a billing period, whether monthly or annual.

For example: if you are on a monthly plan and cancel on the 15th of the month, your subscription will remain active through the end of that month. If you are on an annual plan and cancel after 3 months, you will retain access through the end of the 12-month period. No pro-rated refunds will be issued in either case.

Deleting your account is not the same as cancelling. You may delete your account at any time from the FlagAlert mobile app. Deletion permanently removes your account, your alerts, your settings and your subscription; access ends immediately and a paid subscription is cancelled at once, with no refund for the remainder of the period you have paid for. If you would rather use the time you have paid for, cancel instead — your access then continues to your renewal date as described above.

You may reactivate a cancelled subscription at any time before your current billing period ends. Reactivation restores your subscription without changing your existing billing date or triggering a new charge.

Promotional pricing and trial eligibility: Promotional offers, discounted pricing, and free trial periods are available to new subscribers only. Accounts that have previously cancelled a subscription are not eligible for promotional pricing or a new free trial for a period of six (6) months following the end of their last active subscription period. This policy exists to ensure promotional offers are fairly available to genuinely new customers.

All payments are processed securely by Stripe. We do not store your payment card information.

5. SMS Notifications and Consent

By providing your phone number and subscribing to SMS alerts, you expressly consent to receive automated text messages from FlagAlert at the phone number provided. These are transactional/informational messages related to your subscription.

• Message frequency varies — typically 0 to 5 messages per month
• Message and data rates may apply
• Reply STOP to unsubscribe from SMS at any time
• Reply HELP for assistance

Opting out of SMS notifications does not cancel your subscription. To cancel your subscription, visit your account page at flag-alert.app/account.

6. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• Ensuring your contact information is accurate and up to date
• All activity that occurs under your account
• Notifying us immediately of any unauthorized account access

You may not share your account with others or use the Service for any unlawful purpose.

7. Accuracy of Information

FlagAlert sources flag protocol information from official government sources including the Federal Register and state governor offices. While we strive for accuracy and timeliness, we cannot guarantee that every flag order will be captured or that notifications will be delivered without delay due to technical issues beyond our control.

FlagAlert is an informational aid and should not be your sole source of compliance information. We are not responsible for any consequences arising from missed, delayed, or inaccurate notifications.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Flag Alert LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms of Service or engage in conduct that we determine to be harmful to other users or to our Service. You may terminate your account at any time by contacting us or canceling through your account page.

11. Changes to Terms

We may modify these Terms of Service at any time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the Service after changes are posted constitutes your acceptance of the updated terms.

12. Governing Law

These Terms of Service are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Palm Beach County, Florida.
